Reservation – contract

The reservation is effective when the tenant has made the payment of the rental + guarantee and the lessor has confirmed the reservation in writing. This acts as a contract. The reservation is deemed to have been formed upon receipt of the reservation confirmation by e-mail from the lessor.

The entry of the required banking information, as well as the acceptance of these general conditions and the reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized registers kept in the computer systems will be kept under reasonable security conditions and considered as proof of the communications, orders and payments made between the parties.

Taking possession can take place only if the tenant has paid the full amount of the rental, as well as the deposit as mentioned in the general conditions. l’intégralité du montant de la location, ainsi que le dépôt tel que mentionné dans les conditions générales 

The keys are available to the tenant on the day of arrival from 16h00 jusqu’à 18h00The tenant must imperatively notify the lessor in the event that he should arrive outside the hours provided for above.

If for any reason whatsoever the tenant does not take possession of the rented premises or only occupies them during part of the duration of the contract, he will be required to pay the full rental price provided for in the contract, without being able to claim any deduction.

Cancellation insurance is optional and the responsibility of the tenant

The tenant takes note of the fact that the property can only be inhabited by the person named in the contract and his co-tenant. If the tenant or a co-tenant flagrantly neglects the duty of care in the use of the rented property or if it is occupied by a number of people greater than the maximum number agreed contractually, the lessor may terminate the rental contract without delay/notice and without compensation. In this case, the rent remains due. Other claims or requests for compensation remain reserved. 

During the stay

The tenant will take all necessary precautions under his responsibility to avoid damage of all kinds (water, electricity, frost, etc.). He undertakes to cover the costs resulting from negligence on his part or that of the other occupants of the rented object. 

The tenant must immediately notify the lessor in the event of a defect in the rented item (damage, breakdowns, water leaks, etc.) throughout his stay. The lessee is liable for the damage resulting from the omission to notify the lessor. He cannot claim any reduction in the event of late notification of defects.

The tenant must allow the lessor to inspect the thing insofar as this examination is necessary for maintenance or subsequent rental. These visits can take place every day. 

If damage is noted at the time of delivery of the property or if the inventory is incomplete, the tenant is required to immediately notify the lessor. Failing this, the property is deemed to have been returned in perfect condition.

The lessor is not responsible for the irregularity of the service of water, electricity, heating, internet, etc. and generally declines all responsibility for lack of enjoyment not resulting from its fault.

The tenant imperatively complies with the regulations of the rented object and respects the other inhabitants.


Upon departure, the tenant must leave the apartment in a state corresponding to normal use, the dishes will be cleaned and tidied up, the beds will be unmade, the linens and sheets used deposited in a bag at the entrance of the apartment. Garbage bags, papers, bottles will be sorted in the "Moloks" provided for this purpose.
If these rules are not respected, an amount may be charged for additional cleaning (Fr. 50.-/h)

The lessee is required to compensate the lessor for damage caused to equipment and for items missing from the inventory. The security deposit is returned to the tenant within 14 days, after the inventory of fixtures, minus, if necessary, the cost of restoring the premises and the cost of replacing the elements and equipment made available. If the deposit is insufficient, the tenant agrees to make up the difference, on the basis of supporting documents provided by the lessor. Fees not included in the contract will be deducted from the deposit, any balance refunded within 14 days after departure

The keys must be returned to the lessor on the day of departure before 10:00 a.m. avant 10h00

Other provisions 

Pets are not tolerated as well as children under 10 years old

The tenant may terminate the contract at any time subject to the following conditions: 

  • Up to 30 days before arrival: CHF 100, —management fee 
  •  From 29 days before arrival and no show: 100% of the amount of the rent.

If cases of force majeure, administrative measures, unforeseen or impossible to avoid extraordinary events prevent the rental or the continuation of the rental, the lessor has the possibility (but not the obligation) to reimburse the lessee for the rental or part of rental for the unused period

The lessor is responsible for the reservation and the proper execution of the contract. The liability of the lessor is excluded to the extent permitted by law. Its liability is in particular excluded for the acts and defaults of the tenant (including its co-tenants and guests), the unforeseeable or unavoidable defaults of third parties, force majeure or events that the lessor, the custodian of the keys, the intermediary or others engaged by the lessor could not foresee or avoid despite due diligence. The descriptions of tourist infrastructure or facilities such as sports facilities, public transport, ski lifts, slopes, opening hours of shops, etc., are provided for information purposes only and do not in any way bind the lessor on a legal level.

The tenant is liable for all damage caused by himself or his roommates or guests; fault will be presumed. If damage is found after the return of the rented property, the tenant is also responsible for these insofar as the lessor can prove that they were caused by the tenant (or his roommates or guests)

The provisions of the CO or, failing that, local customs are applicable to anything that is not expressly provided for in this rental contract.

Acceptance of these general conditions is deemed to be an acknowledgment of debt within the meaning of art. 82 LPs.

In the event of a dispute arising from this contract, the parties expressly declare that they will elect the forum at the Entremont court in Sembrancher.

Applicable law / Jurisdiction

These General Conditions are subject to Swiss law. The courts located at the location of the Company's registered office are competent to settle any dispute between the parties, unless otherwise required by law. The Company is free to bring legal action at the seat/domicile of the defendant. This contract constitutes acknowledgment of debt within the meaning of Article 82 of the Federal Law on Debt Enforcement and Bankruptcy (LP). The application of the United Nations Convention on Contracts for the International Sale of Goods (RS is expressly excluded.
